§ 3-9. Alcohol regulations relative to business hours.

  • (a)

    The provisions of this section shall be applicable to every licensee, agent, servant, and employee and any and all other persons affected.

    (b)

    Except as otherwise provided herein, it shall be unlawful for any licensee or any other person to sell, offer for sale, or furnish to others any alcoholic beverages between the hours of 12:00 midnight and 8:00 a.m. on weekdays, and between the hours of 12:00 midnight on Saturday and 8:00 a.m. Monday.

    (c)

    Licensees whose only sale of alcoholic beverages consist of beer and wine by the package may sell such beverages at any time except between 12:00 midnight on Saturday and 12:00 midnight on Sunday.

    (d)

    No retail dealer or licensee for package sales of distilled spirits shall be in his or her place of business or open his or her place of business or furnish, sell, or offer for sale, any distilled spirits at any time prior to 8:00 a.m. or after 11:45 p.m. For purposes of this section, establishments will be considered open if, at any time past 11:45 p.m., there are persons inside the establishment other than regular employees who are engaged in activities to close, clean, or stock the establishment, or if the doors to the establishment are unlocked. The only exception to the above may be caused by emergency repairs to equipment and facilities.

    (e)

    Licensees for the sale of malt beverages and/or wine for consumption on premises shall be and are subject to the following terms and conditions as to the sale of such beverages and hours of operation:

    (1)

    Licensees for the sale of malt beverages and/or wine for consumption on premise shall not keep such establishments open between the hours of (12:00 a.m.) midnight and 6:00 a.m. on any day of the week;

    (2)

    Said licensees shall not sell any alcoholic beverage between 12:00 midnight on Saturday and 6:00 a.m. on Monday;

    (3)

    Licensees for the sale of malt beverages and/or wine for consumption on premises may be open from 6:00 a.m. on Sunday until 9:00 p.m. on Sunday but shall not at any time on Sunday sell, offer for sale, or furnish to others, any alcoholic beverages nor shall such licensee or any other person permit any person or entity to sell, offer for sale, furnish, or bring upon the premises any alcoholic beverage;

    (4)

    No licensee for sale of malt beverage and/or wine for consumption on premises shall offer, provide or allow any live, recorded, or amplified musical performance or entertainment on the premises at any time on Sunday.

    (5)

    Licensees shall be considered open if at anytime past midnight Monday through Saturday and past 9:00 p.m. on Sunday if there are persons inside the premises other than regular employees who are engaged in activities to close, clean, or stock the establishment, or if the doors to the establishment are unlocked. An exception to the above may be caused by emergency repairs to equipment and facilities. Consumption of alcoholic beverages on these premises is expressly prohibited at any time on Sunday.

    (g)

    Licensees for the sale of distilled spirits for consumption on the premises shall not keep such establishments open between the hours of 12:00 o'clock a.m. (midnight) and 8:00 o'clock a.m. on any day of the week. The licensee shall not sell any alcoholic beverages after 11:45 o'clock p.m. on any day of the week. For purposes of this section, establishment will be considered open if at any time past 11:45 o'clock p.m. there are persons inside the establishment other than the regular employees who are engaged in activities to close, clean or stock the establishment or the doors to the establishment are unlocked. The only exception to the above may be caused by emergency repairs to equipment and facilities. The consumption of alcoholic beverages on these premises is expressly prohibited on Sundays.
