§ 2-131. Established, membership.

  • (a)

    Pursuant to O.C.G.A. § 36-74-1, et seq., there is hereby established a code enforcement board.

    (b)

    The board shall consist of five (5) members who shall be residents of the city.

    (c)

    The members of the board shall be appointed by the board of commissioners of the city for three-year terms. Provided, however, of the initial appointments, two (2) shall be appointed for a one-year term, two (2) shall be appointed for a two-year term, and two (2) shall be appointed for a three-year term. Thereafter, all members shall be appointed for three-year terms.

    (d)

    Any member of the board may be reappointed upon approval of the commission.

    (e)

    An appointment to fill any vacancy on the code enforcement board shall be for the remainder of the unexpired term of office. If any member fails to attend two (2) of three (3) successive meetings without cause and without prior approval of the chairperson, the code enforcement board shall declare the member's office vacant, and the local governing body shall promptly fill such vacancy.

    (f)

    Any board member may be suspended and removed for cause. The commission may, with or without cause, refuse to reappoint any member of the code enforcement board at the expiration of his or her term of office.

    (g)

    The members of the code enforcement board shall elect a chairperson, who shall be a voting member, from among the members of the board. The presence of three (3) or more members shall constitute a quorum. Members of the board shall serve without compensation but may be reimbursed for such travel, mileage, and per diem expenses as may be authorized by the commission or as otherwise provided by law.
